Avrupa Konseyine üye imzacı hükümetler, Avrupa Konseyinin
amacının, ekonomik, sosyal, kültürel, bilimsel, hukuki ve idari alanlarda
anlaşmalar yapılması ve ortak bir tutum kabul edilmesi yoluyla üye devletlerin
özellikle ekonomik ve sosyal gelişmelerini kolaylaştırmak için üyeleri arasında
daha yakın bir birlik gerçekleştirmek olduğunu gözönünde bulundurarak:
Kendi ülkelerinde trafik kazalarında zarar görenlerin
haklarının zorunlu bir sigorta sisteminin kurulması yoluyla güvence altına
alınması gerektiğini düşünerek;
Bu konuda üye ülke yasalarının tamamen
yeknesaklaştırılmasının güç olduğunu ancak, her üye devletin kendi ülkesinde
kazalardan zarar görenlere sağlayacağı teminatı artırıcı hükümler getirme
serbestisinin saklı tutulması kaydıyla, zorunlu addedilen temel kuralların
Avrupa Konseyine üye ülkelerde bir örnek hale getirilmesinin yeterli olacağını
dikkate alarak;
Nihayet, uluslararası sigorta büroları ile garanti fonlarının
kurulması ve işletilmesini desteklemenin veya eşdeğerli önlemler almanın
gerekliliğini düşünerek; aşağıdaki hükümler konusunda görüş birliğine
varmışlardır:
MADDE 1
1. Akit tarafların her biri, işbu
sözleşmenin kendisi bakımından yürürlüğe girdiği tarihten itibaren en geç altı
ay içinde, kendi toprakları üzerinde herhangi bir motorlu taşıtın zarar verdiği
kimselerin haklarının, işbu sözleşmenin ek hükümlerine (Ek: 1) uygun zorunlu
bir sigorta sisteminin kurulması yoluyla teminat altına alınmasını taahhüt eder.
2. Bununla birlikte, her akit taraf, zarar
gören kişiler lehine teminatı artırıcı hükümler kabul etme hakkını saklı tutar.
3. Akit tarafların her biri, motorlu
taşıtların zorunlu sigorta sistemini kuran kendi mevzuat ve bellibaşlı
yönetmelik tedbirlerine ilişkin resmi belgeleri Avrupa Konseyi Genel
Sekreterine iletecektir. Genel Sekreter bu belgeleri diğer akit taraflara ve
Avrupa Konseyine üye diğer devletlere ulaştıracaktır.
MADDE 2
Her akit taraf:
1. Kendisi tarafından tehlikesiz sayılan
bazı motorlu taşıtları zorunlu sigortadan muaf tutma;
2. Milli veya yabancı kamu mercilerine veya
hükümetlerarası kuruluşlara ait motorlu taşıtları zorunlu sigortadan muaf
tutma;
3. Sigortanın yapılabileceği asgari tutarı
belirleme; hakkını saklı tutar. Bu son halde, ek hükümlerin uygulanması bu
suretle belirlenmiş tutarlarla kısıtlanabilecektir.
MADDE 3
1. Her akit taraf, işbu sözleşmenin
imzalanması yahut onay veya katılma belgesinin tevdii sırasında, işbu
sözleşmenin II. numaralı ekinde yeralan çekincelerden birini ya da birkaçını
kullandığını beyan edebilir.
2. Her akit taraf, yukardaki paragraf
gereğince koymuş olduğu bir çekinceyi, Avrupa Konseyi Genel Sekreterine
tebligatta bulunmak yoluyla tamamen veya kısmen geri alabilir. Tebligat
alındığı tarihten itibaren hüküm ifade eder. Genel Sekreter, tebligatı diğer
akit taraflar ile Avrupa Konseyinin diğer üyelerine iletir.
MADDE 4
1. Akit taraflardan birinin, işbu
sözleşmenin ikinci ve üçüncü maddeleri uyarınca kullanmış olduğu seçme hakkı
veya çekinceler yalnız kendi topraklarında geçerli olacak, diğer akit
tarafların topraklarında bu ülkelerin zorunlu sigorta yasalarının uygulanmasını
engellemeyecektir.
2. Her akit taraf, işbu sözleşmenin ikinci
ve üçüncü maddelerinde belirtilen seçme hakkı ve çekincelere ilişkin ulusal
mevzuatının içeriğini Avrupa Konseyi Genel Sekreterine bildirecektir. Her akit
taraf, sözkonusu mevzuatta sonradan yapılan her değişiklikten Genel Sekreteri
haberdar kılacaktır. Genel Sekreter bütün bu bilgileri diğer akit taraflara ve
Avrupa Konseyinin diğer üyelerine iletecektir.
MADDE 5
Bir motorlu taşıtın neden olduğu zararın tazmini zorunlu
trafik sigortasıyla birlikte sosyal güvenlik mevzuatını da ilgilendiriyor ise,
zarar gören kişinin hakları ve bu iki sisteme ilişkin düzenlemeler yerel
yasalar çerçevesinde kararlaştırılacaktır.
MADDE 6
1. Her akit taraf yerel yasaları, ek
hükümlerin dördüncü maddesinin ikinci paragrafında belirtilen normal sigortanın
dışında tutma olanağını tanıyorsa, kendi topraklarında hız, mukavemet veya
maharet yarış veya yarışmaları düzenlenmesini idari izne tabi tutmayı taahhüt
eder. Bu izin ancak, ek hükümlerle uyumlu özel bir sigortanın, yarışma
düzenleyen kişi ve kuruluşların bu hükümlerin üçüncü maddesinde belirtilen mali
sorumluluklarını teminat altına alması halinde geçerlidir.
2. Bununla birlikte, geçen paragrafta
belirtilen yarış veya yarışmalara katılan araçlarda bulunanların zararlarının
tazmini bu sigortanın dışında tutulabilir.
MADDE 7
1. Genellikle, herhangi bir akit devletin
ülkesinde kayıtlı olmayan motorlu taşıtlar, bu ülkede ek hükümlerin ikinci
maddesinin uygulanmasından muaf tutulacaktır. Ancak, bunun için, sözkonusu
motorlu taşıtlar bir başka akit devlet hükümeti tarafından verilen ve aracın bu
devlete yahut federal bir devlet ise federal devlete veya onu oluşturan
devletlerden birine mensup olduğunu gösteren bir belgeye sahip olmalıdırlar. Bu
son halde, belge federal hükümet tarafından verilecektir.
2. Bu belge, katedilen ülke kanununa uygun
olarak zararı tazmin etmekle yükümlü olan ve aynı yasaya göre yetkili
mahkemeler önünde aleyhinde dava açılabilecek merci veya organı
belirleyecektir. Aracın mensup olduğu devlet veya federal üye, sözkonusu
tazminatın ödenmesini taahhüt edecektir.
MADDE 8
Akit taraflar, uluslararası sigorta belgeleri çıkaracak ve
ek hükümlerin ikinci maddesinin ikinci paragrafında öngörülen zararları tazmin
edecek büroların kuruluş ve işleyişini teşvik edeceklerdir.
MADDE 9
1. Her akit
taraf, sigorta zorunluluğuna uyulmadığı veya sorumlunun saptanamadığı veya ek
hükümlerin üçüncü maddesinin birinci paragrafının ilk cümlesinde öngörülen
muafiyet hallerinde meydana gelen zararla ilgili mali sorumluluk nedeniyle
zarar gören kişilere tazminat verilebilmesi için bir garanti fonu kurmayı veya
eşdeğerde düzenlemeler yapmayı taahhüt eder. Tazminat hakkının tanınma
şartlarını ve kapsamını ilgili akit taraf tayin eder.
2. Her akit
tarafın yurttaşları, bir önceki paragrafta öngörülmüş hakkı bir başka akit
ülkede o devletin yurttaşları ile aynı ölçüde ileri sürme hakkına sahip
olacaklardır.
MADDE 10
1. Akit
taraflar, yerel yasalarında, motorlu taşıtın sigorta ettirilmesinden kimlerin
sorumlu olduğunu tespit etmeyi ve bu konuda tüm uygun önlemleri almayı taahhüt
ederler. Akit taraflar, gerektiğinde ve ek hükümlerden doğan vecibelere
uyulmasını sağlamak amacıyla bu önlemleri cezai ve idari yaptırımlara
bağlayabilirler.
2. Akit
taraflar, ek hükümlerin uygulanmasını sağlamak amacıyla, sigortacılara ve
gerektiğinde Garanti Fonu ve Büroya ilişkin onaylama, onayın son bulması veya
geri alınması hususları ile bu kuruluşların denetimi konusunda yerel
mevzuatlarında gerekli hükümlere yer vermeyi taahhüt ederler.
MADDE 11
1. Her akit
taraf, gerektiğinde, ek hükümlerin dokuzuncu maddesinde anılan bildirimin
yapılacağı merci veya kişiyi tespit eder.
2. Her akit
taraf, sigortalı taşıtın mülkiyetinde olabilecek değişikliğin sigorta
sözleşmesine etkilerini kararlaştırır.
MADDE 12
İvedi haller dışında, hiçbir akit taraf, işbu sözleşmeyi,
kendisi bakımından yürürlüğe girdiği tarihten itibaren iki yıl geçmeden
feshedemeyecektir. Fesih Avrupa Konseyi Genel Sekreterine yazılı bir bildirimle
iletilecektir. Avrupa Konseyi Genel Sekreteri fesih bildirimden diğer akit
tarafları haberdar edecektir. Fesih, Genel Sekreterce bildirimin alınmasından
üç ay sonra yürürlüğe girecektir.
MADDE 13
1. Akit
taraflardan biri, kendi açısından bu sözleşmenin yürürlüğe girmesinden sonra,
işbu sözleşmenin ek II'sinde belirtilmemiş veya belirtildiği halde uygulanmamış
veya geri çekilmiş bir çekinceyi kullanmayı gerekli görürse, çekince önerisini
kapsamı ve içeriği açık biçimde belirlenmiş bir metin şeklinde Genel Sekretere
sunar. Genel Sekreter, işbu paragraf uyarınca kendisine yapılan bildirimleri
diğer akit taraflara iletir.
2. Diğer akit
taraflar, Genel Sekreterin kendilerine çekincenin metnini iletmesinden itibaren
altı aylık süre içinde bu çekinceyi kabul ettiklerini yazılı olarak beyan
ederler ise, çekinceyi öne süren akit taraf mevzuatını istenen yönde
değiştirebilir. Genel Sekreter, işbu paragraf uyarınca kendisine yapılan
tebliğleri akit tarafların bilgisine sunacaktır.
MADDE 14
İşbu sözleşme akit tarafların deniz aşırı topraklarına
uygulanmaz.
MADDE 15
1. İşbu
sözleşme Avrupa Konseyi üyelerinin imzasına açıktır. Sözleşme onaya tabidir.
Onay belgeleri Avrupa Konseyi Genel Sekreterine tevdi edilecektir.
2. İşbu
sözleşme, dördüncü onay belgesinin tevdi tarihinden 90 gün sonra yürürlüğe
girecektir.
3. Sözleşme,
sözleşmeyi sonradan onaylayacak bir imzacı devlet bakımından, onay belgesinin
tevdi tarihinden 90 gün sonra yürürlüğe girecektir.
4. Genel
Sekreter, imzacı devletlerin isimlerini, sözleşmenin yürürlüğe girdiğini,
sözleşmeyi onaylayan akit tarafların isimlerini ve sonradan onay veya katılma
belgesi tevdiini bütün Konsey üyelerine tebliğ edecektir.
MADDE 16
İşbu sözleşmenin yürürlüğe girmesinden sonra, Avrupa
Konseyi Bakanlar Komitesi, Konsey üyesi olmayan devletleri sözleşmeye katılmaya
davet edebilir. Böyle bir çağrı alan her devlet, katılma belgesini Avrupa
Konseyi Genel Sekreterine tevdi ederek sözleşmeye katılabilecektir. Genel
Sekreter, katılma belgesinin tevdiini bütün akit taraflara ve Avrupa Konseyinin
diğer üyelerine tebliğ edecektir. Sözleşme, katılan her devlet bakımından,
katılma belgesinin tevdi tarihinden 90 gün sonra yürürlüğe girecektir.
Yukarıdaki hükümleri kabul anlamında tam yetkili kılınmış aşağıda imzaları
bulunanlar, işbu sözleşmeyi imzalamışlardır. Avrupa Konseyi arşivlerinde
saklanacak olan işbu sözleşme, Fransızca ve İngilizce olarak ve her iki metin
aynı derecede geçerli bulunmak üzere, tek nüsha halinde, 20 Nisan 1959 tarihinde
Strazburg'da tanzim edilmiştir. Genel Sekreter, imzacı devletlerin her birine
bu sözleşmenin aslına uygun örneklerini tevdi edecektir.

MADDE 1
İşbu sözleşmede:
"Motorlu taşıtlar" teriminden: Demiryolu taşıtları
hariç, yer üzerinde ilerlemeye yarayan ve mekanik bir güçle harekete
geçirilebilen araçlar ile hükümet tarafından belirlenecek bağlı ve bağlı
olmayan yedek arabaları anlaşılır. Ancak bu son halde, yedek arabaların bir
motorlu taşıta bağlı olarak kullanılacak şekilde imal edilmiş bulunmaları ve
insan ve mal nakliyatına hasredilmiş olmaları gereklidir; "Sigortalı"
teriminden: İşbu yasanın hükümleri gereğince sorumlulukları teminat altına
alınmış kişiler anlaşılır; "Zarar görmüş kişiler" teriminden: Motorlu
taşıtın neden olduğu zarardan dolayı tazminat hakkına sahip olanlar anlaşılır;
"Sigortacı" teriminden: İkinci maddenin birinci paragrafı uyarınca hükümet
tarafından tanınmış sigorta şirketi ve aynı maddenin ikinci paragrafına göre
genellikle ülke dışında kayıtlı taşıtların ulusal topraklar üzerinde neden
oldukları zararların tazmini ile yükümlü Büro anlaşılır.
MADDE 2
1. Ferdi
sorumluluk, bu sözleşme hükümlerine uygun şekilde teminat altına alınmadıkça,
motorlu taşıtlar, kamu yollarında, halka açık alanlarda ve belirli kişilerin
geçiş hakkına sahip olduğu özel arazilerde kullanılamazlar. Sigorta sözleşmesi,
hükümetçe yetki verilmiş bir sigortacı ile akdedilmelidir.
2. Bununla
birlikte, genellikle ülke dışında kayıtlı taşıtlar, hükümetçe yetki verilen bir
Büronun, bu taşıtların neden olduğu hasarlardan zarar gören kişilerin yerel
kanuna göre tazmin edilmesi yükümlülüğünü üzerine alması koşuluyla, ülke
topraklarında kullanılabilir.
MADDE 3
1. Sigorta,
sigorta edilmiş taşıtın sahibinin, zilyedinin ve sürücüsünün mali sorumluluğunu
teminat altına almalıdır. Ancak, hırsızlık veya tehdit suretiyle veya sahibinin
veya zilyedinin izni olmaksızın aracı ellerine geçirenlerin ferdi sorumluluğunu
sigorta teminat altına almaz. Bununla birlikte, aracı kullanan, sahibin veya
zilyedin bir hatası sonucunda aracı eline geçirmişse veya aracın kullanımına
memur edilmiş bir kişi ise, sigorta, sürücünün mali sorumluluğunu teminat
altına almalıdır.
2. Sigorta,
sigorta edilmiş taşıta ve bu taşıt tarafından taşınan mallara ilişkin zarar
dışında, ulusal topraklar üzerinde kişilere ve mallara verilen zararları
kapsamalıdır.
MADDE 4
1. Aşağıda
belirtilen kişiler sigortadan yararlandırılmayabilirler:
a) Zarara neden olan
aracın sürücüsü, sigorta sözleşmesini akdeden kişi ve mali sorumlulukları
poliçe tarafından teminat altına alınan bütün şahıslar,
b) Yukarıdaki
paragrafta belirtilen kişilerin eşleri,
c) Bu kişilerin
ailelerinin üyeleri olup, aynı çatı altında yaşayan veya onların olanakları ile
geçinen veya zarara neden olan aracın içinde bulunan kişiler,
2. Aracın,
düzenlenmelerine izin verilen yarışlara veya hız, mukavemet veya maharet
yarışmalarına katılması sonucunda meydana gelen zararlar normal sigortanın
dışında tutulabilir.
MADDE 5
Sözleşme, sigortalının belirli bir ölçüde zararın tazminine
katılmasını öngörse dahi sigortacı, zarar görmüş kişiye, sözleşme uyarınca
sigortalı tarafından karşılanması gereken katılma payını da ödemekle
yükümlüdür.
MADDE 6
1. Zarar görmüş
kişinin sigortacıya karşıdoğrudan talep hakkı vardır.
2. Zarar görmüş
birden çok kişi varsa ve ödenmesi gereken tazminatın tutarı sigorta tarafından
garanti edilmiş tutarı aşıyorsa, zarar görmüş kişilerin sigortacıya karşı
talepleri bu meblağ çerçevesinde nisbi bir indirime tabi tutulur. Bununla
birlikte, eğer sigortacı, diğer taleplerin varlığından haberdar olmaksızın,
zarar görmüş kişilere, iyi niyetle, haklarına düşen paydan daha yüksek bir
miktar ödemişse, diğer zarar görmüş kişilere karşı ancak sigortanın garanti
ettiği tutarın geriye kalan kısmını ödemekle yükümlü olur.
MADDE 7
1. Sigortalılar,
haberdar oldukları tüm kazaları sigortacıya bildirmelidirler. Poliçenin sahibi
sigortacıya sigorta mukavelesinde belirtilen her türlü bilgi ve belgeyi
vermelidir. Poliçenin sahibi dışındaki sigortalılar, sigortacıya talep edeceği
bütün gerekli bilgi ve belgeleri vermekle yükümlüdür.
2. Sigortacı,
zarar görmüş kişi tarafından kendisine açılan davaya sigortalıyı taraf
kılabilir.
MADDE 8
1. Zarar görmüş
kişinin sigortacıya karşıdoğrudan taleplerine ilişkin herhangi bir dava hakkı,
zarar konusu olaydan itibaren iki sene sonra zaman aşımına uğrar.
2. Yazılı bir
talep, sigortacı müzakerelere son verdiğini yazılı olarak bildirinceye kadar,
zaman aşımını durdurur. Daha sonra vaki talepler zaman aşımını durdurmaz.
MADDE 9
1. Sigortacı, sözleşme ve ilgili yasal
hükümler gereğince, sigortalıya karşı sahip bulunduğu hakları, ödemeleri
reddetme veya kısma amacıyla zarar görmüş kişiye dermeyan edemez.
2. Sigortacı, sözleşmenin butlanını sona
ermesini, durdurulmasını veya teminatın durdurulmasını, zarar görmüş kişiye
ancak, butlanın, sona ermenin veya durdurulmanın tebliğinden 16 günlük bir süre
geçmesinden sonra vuku bulacak kazalar için dermeyan edebilir. İlk sigortayı
izleyen başka sigortaların varlığı halinde, bu hüküm ancak sonuncu sigortacıya
uygulanır.
3. Bununla birlikte, zararın, başka bir
sigorta tarafından fiilen tazmin edilmesi halinde, önceki paragrafların
hükümleri uygulanmaz.
4. İşbu maddenin birinci ve ikinci
paragraflarının kapsamına giren hükümler, sigortacının, poliçe sahibi veya
poliçe sahibi dışındaki bir sigortalıya karşı olan rücu hakkına hiç bir surette
halel getirmez.
MADDE 10
İşbu sözleşme hükümlerince öngörülmüş olmadıkça, kişiler,
özel sözleşmelerle, zarar görmüş kişiler lehine vaz'e edilmiş bulunan bu
sözleşme hükümlerine aykırı hükümler getiremezler.
EK II:
SÖZLEŞMEYE KONABİLECEK ÇEKİNCELER
SÖZLEŞMEYE KONABİLECEK ÇEKİNCELER
Akit tarafların her biri, aşağıdaki düzenlemeleri yapabilir:
1. Kendi kendilerinin sigortacısı olmalarını
sağlayacak yeterli maddi teminatı göstererek kamu hukuku veya özel hukuk tüzel
kişilerine ait motorlu taşıtları zorunlu sigortadan muaf tutabilir.
2. Kendisi tarafından tespit edilecek bazı
kişiler için sigorta yerine teminat akçesi usulünü koyabilir. Ancak, bu
takdirde, teminat akçesinin, zarar görmüş kişilere, sigorta teminatına eşdeğer
teminatı sağlaması gereklidir.
3. Bir sigortalı tarafından kasten verilen
zararları zorunlu sigorta dışında tutabilir.
4. Ek hükümlerin üçüncü maddesinin birinci
paragrafının ikinci cümlesinde öngörülen halleri zorunlu sigortadan muaf
tutabilir.
5. Zarar görmüş kişilerin hiç değilse
bedeni zararlarının tazmin edileceğine dair teminatları bulunması şartıyla, mal
sahibinin veya zilyedin izni olmaksızın veya bunların talimatları hilafına bir
aracın kullanımını zorunlu sigorta kapsamı dışında tutabilir.
6. Manevi zararı zorunlu sigortadan muaf
tutabilir.
7. Sigortalının hükmi şahıs veya özel
hukuki şahsiyete haiz olmayan bir kurum veya ticari şirket olması halinde, sigortalının
yasal temsilcilerini ve eşlerini ek hükümlerin dördüncü maddesinin birinci
paragrafının (c) bölümünde öngörülen şartlar içinde, bu temsilcilerin aile
üyelerini sigortadan faydalandırmayabilir.
8. Bir aracın hukuk dışı yollarla meşru
zilyedinin elinden alındığını veya bir cürüm işlemek üzere kullanıldığını
bildiği veya bilmesi gerektiği halde bu araç ile yolculuk yapmayı kabul eden
kişiler motorlu taşıt sigortasından yararlandırılmayabilir.
9. Bedava veya gönüllü taşıma halinde,
zarara sebep olan araçta bulunan kişilere verilen zararları zorunlu sigortadan
muaf tutabilir.
10. Kamu alanı olmayan fakat bazı kimselere
açık alanlarda gidip gelen taşıtları ve kamu yolu haricinde düzenlenen
yarışlara veya hız mukavemet veya maharet yarışmalarına katılan araçları
zorunlu sigortadan muaf tutabilir.
11. Yalnız kendi yurttaşları arasındaki
ilişkilerde, düşük tutardaki maddi zararlarla ilgili ek hükümlerin beşinci
maddesine istisnalar getirebilir.
12. Kendi topraklarında meydana gelen bir
zararla ilgili olarak, ek hükümlerin altıncı maddesinin uygulanmasını,
gerektiğinde temel ilkeler hakkında bilgi vererek mahkemelerinin takdirine
bırakabilir.
13. Toplam teminatın dağılımını başka esaslara
göre düzenleyen bir yönetmelik hazırlayarak, ek hükümlerin altıncı maddesinin
ikinci paragrafına bazı istisnalar getirebilir.
14. Ek hükümlerin sekizinci maddesinin ikinci
paragrafının hükümlerine bazı istisnalar getirebilir.
15. Ek hükümlerin dokuzuncu maddesinde
öngörülen durumlarda, zarar görmüş kişi bedeni ve maddi zararlarını
karşılayacak teminata sahip bulunduğu takdirde, anılan madde hükümlerine

16. Genellikle kendi ülkesi dışında kayıtlı
motorlu taşıtlarla ilgili olarak, ek hükümlerin dokuzuncu maddesinin ikinci
paragrafına istisnalar getirebilir.

Sigortasına İlişkin Avrupa Sözleşmesini imzalamakla, işbu sözleşmeye ek

European Convention on Compulsory Insurance Against Civil
Liability in Respect of Motor Vehicles The Governments signatory hereto, being
Members of the Council of Europe, Considering that the aim of the Council of
Europe is to achieve greater unity among its Members for the purpose, among
others, of facilitating their economic and social progress by the conclusion of
agreements and common action in economic, social, cultural, scientific, legal and
administrative matters; Considering it necessary to safeguard the rights of
victims of motor accidents in their territories by the introduction of a system
of compulsory insurance;
Considering that it would be difficult to secure the
complete unification of their laws in this matter and that it would suffice if
such basic rules as are considered essential were tandardised in the member
countries of the Council of Europe, each country remaining free to apply in its
territory provisions affording greater protection to injured parties;
Considering it necessary, moreover, to promote the establishment and operation
of international insurance bureaux and guarantee funds, or to take equivalent
measures, Have agreed as follows:
ARTICLE 1
1. Each Contracting Party undertakes to
ensure that, within six months of the date of entry into force of this
Convention in respect of that Party, the rights of persons suffering damage
caused by motor vehicles in its territory shall be protected through the
introduction of a system of compulsory insurance complying with the provisions
annexed to this Convention (Annex I).
2. Each Contracting Party shall, however,
retain the option of adopting provisions affording greater protection to
injured parties.
3. Each of the Contracting Parties shall
communicate to the Secretary-General of the Council of Europe the official
texts of the legislation and principal regulations establishing its system of
compulsory motor insurance. The Secretary-General shall transmit these texts to
the other Parties and to the other Members of the Council of Europe.
ARTICLE 2
Each Contracting Party shall retain the option:
1. to exempt from compulsory insurance
certain motor vehicles, the use of which it considers to present little if any
danger;
2. to exempt from compulsory insurance
motor vehicles owned by its public authorities or those of other countries or
by inter-governmental organisations;
3. to determine the minimum amounts of
insurance cover necessary; in this case, the application of the annexed provisions
may be limited to these amounts.
ARTICLE 3
1. Any Contracting Party may, when signing
this Convention or on depositing its instrument of ratification or accession,
declare that it avails itself of one or more of the reservations provided for
in Annex II to the Convention.
2. Any Contracting Party may wholly or
partly withdraw a reservation it has made in accordance with the foregoing
paragraph by means of a notification addressed to the Secretary-General of the
Council of Europe which shall become effective as from the date of its receipt.
The Secretary-General shall communicate the notification to the other Parties
and to the other Members of the Council of Europe.
ARTICLE 4
1. Options
exercised and reservations made by a Contracting Party in pursuance of Articles
2 and 3 of this Convention shall be valid only in its territory and shall not
prejudice the full application of the compulsory insurance law of other Parties
in whose territory the vehicle is used.
2. Each
Contracting Party shall inform the Secretary-General of the Council of Europe
of the content of its legal provisions relating to the options and reservations
referred to in Articles 2 and 3 of this Convention. The said Party shall keep
the Secretary-General informed of any changes made therein at a later date. The
Secretary-General shall transmit all such information to the other Parties and
to the other Members of the Council of Europe.
ARTICLE 5
When compensation for injury caused by a motor vehicle
involves both compulsory motor insurance and social security schemes, the
rights of the injured party and the arrangements to be made between the two
systems shall be determined under municipal law.
ARTICLE 6
1. Should the
option of exclusion from normal insurance referred to in paragraph 2 of Article
4 of the annexed provisions be provided for in its municipal law, each
Contracting Party undertakes to make the holding in its territory of motor
races or competitions, whether for speed, reliability or skill, subject to
official authorisation. Such authorisation shall be granted only if the civil
liability of the organisers and the persons referred to in Article 3 of the
annexed provisions is covered by special insurance complying with those
provisions.
2. Compensation
for damage suffered by the occupants of vehicles taking part in races or
competitions such as are referred to in the foregoing paragraph may, however,
be excluded.
ARTICLE 7
1. Motor
vehicles normally stationed outside the territory of a Contracting State shall
be exempt in that territory from the application of Article 2 of the annexed
provisions if they are provided with a certificate issued by the Government of
another Contracting State stating that the vehicle belongs to that State, or,
in the case of a Federal State, to the Federal State or one of its constituent
members; in the latter case, the certificate shall be issued by the Federal
Government.
2. The
certificate shall indicate the authority or body responsible for paying
compensation in accordance with the law of the country visited and which may be
sued in the courts competent in such matters under that law. The State or
constituent member to which the vehicle belongs shall guarantee such payment.
ARTICLE 8
The Contracting Parties shall promote the establishment and
operation of Bureaux for the issue of international insurance certificates and
for meeting claims for damages in the circumstances specified in paragraph 2 of
Article 2 of the annexed provisions.
ARTICLE 9
1. Each of the
Contracting Parties undertakes either to establish a guarantee fund or to make
other equivalent arrangements in order to compensate injured parties for damage
caused in such circumstances that a civil liability is incurred, where the
obligation to be insured has not been complied with or the person liable has
not been identified, or the case is one excepted from insurance in accordance
with the first sentence of paragraph I of Article 3 of the annexed provisions.
The conditions for granting compensation and the extent of such right shall be
determined by the Contracting Party concerned.
2. Nationals of
any Contracting Party shall be entitled to bring the claim provided for in the
foregoing paragraph in any other Contracting State on equal terms with the
nationals of that State.
ARTICLE 10
1. The Contracting
Parties undertake to determine in their municipal law the persons who shall be
responsible for having the motor vehicle insured and to take all appropriate
measures, accompanied where necessary by penal or administrative sanctions, to
enforce the obligations resulting from the annexed provisions.
2. With a view
to the application of the annexed provisions, the Contracting Parties undertake
to make appropriate provisions in their municipal law relating to the approval,
or the expiry or withdrawal of the approval, of insurers and, if necessary, of
the Guarantee Fund and the Bureau, and also relating to control of their
operations.
ARTICLE II
1. Each
Contracting Party shall determine, as may be necessary, the authority or person
to whom the notification mentioned in Article 9 of the annexed provisions is to
be made.
2. Each
Contracting Party shall determine what effect the insurance contract shall have
in the case of a change of ownership of the insured vehicle.
ARTICLE 12
Except in case of emergency, a Contracting Party may not
denounce this Convention within less than two years from the date on which the
Convention entered into force in respect of that Party. Denunciation shall be
effected by written notification to the Secretary-General of the Council of Europe,
who shall inform the other Contracting Parties thereof; it shall take effect
three months after the date on which the Secretary-General received such
notification.
ARTICLE 13
1. If, after
the entry into force of the Convention in respect of a Contracting Party, that
Party deems it necessary to make a reservation, either not provided for in
Annex II to this Convention or, if provided for in that Annex, a reservation
which it has not made previously or has withdrawn, it shall inform the
Secretary-General of the Council of Europe of its precise proposal, of which
the Secretary-General shall then notify the other Contracting Parties.
2. If, within
the six months following the notification by the Secretary-General, the
Contracting Parties signify in writing their agreement to the proposal, the
Contracting Party which has made the proposal may amend its legislation
accordingly. The Secretary-General shall bring the notifications made to him
under this paragraph to the knowledge of the
Contracting Parties.
ARTICLE 14
This Convention shall not apply to overseas territories of
the Contracting Parties.
ARTICLE 15
1. This
Convention shall be open to the signature of the Members of the Council of
Europe. It shall be ratified. Instruments of ratification shall be deposited
with the Secretary-General of the Council of Europe.
2. This
Convention shall come into force 90 days after the date of deposit of the
fourth instrument of ratification.
3. In respect
of any signatory ratifying subsequently, the Convention shall come into force
90 days after the date of deposit of its instrument of ratification.
4. The
Secretary-General shall notify all the Members of the Council and acceding
States of the names of the Signatories, of the entry into force of the
Convention, the names of the Contracting Parties who have ratified it and the
subsequent deposit of any instrument of ratification or accession.
ARTICLE 16
After this Convention has come into force the Committee of
Ministers of the Council of Europe may invite any State which is not a Member
of the Council to accede to it. Any State so invited may accede by depositing
its instrument of accession with the Secretary-General of the Council, who
shall notify all the Contracting Parties and the other Members of the Council
of Europe of such deposit. The Convention shall come into force in respect of
any State acceding thereto 90 days after the date of deposit of its instrument
of accession. In witness whereof, the undersigned, being duly authorised
thereto, have signed this Convention. Done at Strasbourg, this 20th day of
April 1959, in the English and French languages, both texts being equally
authoritative, in a single copy which shall remain in the archives of the
Council of Europe and of which the Secretary-General shall send certified
copies to each of the Signatories.

PROVISIONS ANNEXED TO THE CONVENTION
PROVISIONS ANNEXED TO THE CONVENTION
ARTICLE I
For the purpose of this law:
The term "motor vehicles" shall mean:
mechanically-propelled vehicles intended to be driven on the ground other than
vehicles running on rails, and shall include trailers when coupled, and insofar
as the Government so decides, uncoupled trailers which are constructed or
adapted to be towed by a motor vehicle and to carry persons or goods;
The term "assured" shall mean: persons whose
liability is covered in accordance with this law;
The term "injured parties" shall mean: persons
entitled to compensation for damage caused by a motor vehicle;
The term "insurer" shall mean: the insurance
undertaking approved by the Government in accordance with paragraph 1 of
Article 2, and, in the case of paragraph 2 of Article 2, the Bureau responsible
for the settlement of claims for damage caused in the national territory by
vehicles normally stationed outside that territory.
ARTICLE 2
1. No motor vehicle may be driven on the
public highway, in grounds open to the public or in private grounds to which
certain persons have right of access, unless the civil liability to which it
may give rise is covered by insurance in accordance with the provisions of this
law.
The insurance must be effected with an insurer approved by
the Government for this purpose.
2. Nevertheless, motor vehicles normally
stationed outside the national territory may be driven in that territory on
condition that a Bureau recognised for this purpose by the Government assumes
direct responsibility for compensating, in accordance with municipal law,
injured parties for damage caused by such vehicles.
ARTICLE 3
1. The insurance must cover the civil
liability of the owner and of any driver or person in charge of the insured
vehicle, with the exception of persons who have taken control thereof either by
theft or violence or merely without the consent of the owner or person in
charge. Nevertheless, in the latter case the insurance must cover the civil
liability of the driver if he has been able to take control of the vehicle
through the fault of the owner or person in charge, or if he is a person
employed to drive the vehicle.
2. The
insurance must include damage caused to persons and property in the national
territory, with the exception of damage to the insured vehicle and to property
carried by it.
ARTICLE 4
1. The
following may be excluded from the benefits of the insurance:
(a) the driver of the
vehicle causing the damage, the policy-holder and all persons whose civil
liability is covered by the policy;
(b) the spouses of the
persons mentioned above;
(c) members of the
families of those persons, provided either that they reside with them or are
dependent on them for their maintenance, or that they are carried in the
vehicle which caused the damage.
2. Damage
caused by the vehicle during participation in authorised motor races or
competitions, whether for speed, reliability or skill may be excluded from the
normal insurance.
ARTICLE 5
Should it be stipulated in the policy that the assured shall
himself make some contribution towards compensation for the damage, the insurer
shall nevertheless remain liable to the injured party for payment of the
contribution which the contract lays down as being due by the assured.
ARTICLE 6
1. The injured
party has a direct claim against the insurer.
2. Should there
be more than one injured party, and the total compensation due exceed the sum
insured, the rightful claims of the injured parties against the insurer shall
be reduced in proportion to that sum. Nevertheless, an insurer who, through
ignorance of the existence of other claims, has in good faith paid an injured
party more than that party's proper share, shall be accountable to the other
injured parties only for the remainder of the sum insured.
ARTICLE 7
1. The assured
must report to the insurer all accidents of which they have knowledge. The
policy-holder must supply the insurer with any information or documents
stipulated in the policy. Assured persons other than the policy-holder must
supply any information or documents required by the insurer, at the latter's
request.
2. The insurer
may make the assured a party to an action brought against him by the injured
party.
ARTICLE 8
1. Any action
by the injured party against the insurer based on the former's direct claim
against him shall be barred after two years have elapsed since the time of the
accident.
2. A written
request shall suspend the period of limitation in respect of the insurer until
such time as he states in writing that he has broken off negotiations. The
period of limitation shall not be suspended by subsequent requests.
ARTICLE 9
1. The insurer may not raise against an injured
party the rights which he possesses vis-a-vis the assured, by virtue of the
contract or of the provisions of the law relating to it, to withhold or reduce
its benefits.
2. The invalidity or termination of the
insurance contract, its suspension or that of the guarantee thereunder may be
raised by the insurer against the injured party only in respect of accidents
occurring after 16 days have elapsed since the insurer gave notice of the said
invalidity, termination or suspension. In the case of consecutive insurances
this provision shall apply only to the last insurer.
3. However, the provisions of the preceding
paragraphs shall not be applicable insofar as the damage is effectively covered
by another insurance.
4. The provisions of paragraphs 1 and 2 of the
present Article shall in no wise prejudice the insurer's right to take action
against the policy-holder or an assured person other than the policy-holder.
ARTICLE 10
No departure by way of agreement between individuals may be
made from those provisions of this law which are designed to protect injured
parties, unless the right to do so follows from those provisions.
ANNEX II
RESERVATIONS TO THE CONVENTION
RESERVATIONS TO THE CONVENTION
Each Contracting Party may state its intention:
1. to exempt from compulsory insurance
motor vehicles owned by corporate persons under public or private law able to
provide sufficient financial guarantee to be their own insurer;
2. to allow the deposit of a security in
lieu of insurance by such persons as it shall determine, provided, however,
that such security offers injured parties safeguards equivalent to those
afforded by the insurance;
3. to exclude from compulsory insurance
wilful damage caused by the assured;
4. to exempt from compulsory insurance the
cases specified in the second sentence of paragraph I of Article 3 of the
annexed provisions;
5. to exempt from compulsory insurance the
driving of a vehicle without the consent of the owner or person in charge, or
in contravention of their orders, provided that in such cases the injured party
has a guarantee of compensation, at least in respect of damage to person;
6. to exempt from compulsory insurance
damages for pain and suffering;
7. to exclude from benefit under the
insurance, when the assured is a corporate person or a commercial company not
possessing legal personality, the legal representatives of the assured, and the
spouses of such representatives, and, under the terms of paragraph I(c) of
Article 4 of the annexed provisions, members of the families of such
representatives;
8. to exclude from benefit under the
insurance of a motor vehicle any person who is carried with his consent in that
vehicle although he knows or should have known that the vehicle was taken from
the rightful possessor by an unlawful act or is being used in the perpetration
of a criminal offence;
9. to exempt
from compulsory insurance damage to passengers in the vehicle that was the
cause of such damage, if they were being carried free of charge or as a favour;
10. to exempt
from compulsory insurance motor vehicles while being driven in private grounds
to which certain persons have right of access and also motor vehicles while
taking part elsewhere than on the public highway in motor races or
competitions, whether for speed, reliability or skill;
11. to depart,
solely as between its own nationals, from the terms of Article 5 of the annexed
provisions in regard to damage to property involving small sums;
12. to leave it
to its courts to decide whether, in the case of damage caused in its territory,
Article 6 of the annexed provisions shall apply, indication being given where
necessary to the courts of the principles on which they should proceed;
13. to depart
from the provisions of paragraph 2 of Article 6 of the annexed provisions with
a view to providing an alternative method of apportioning the sum insured;
14. to depart from
the provisions of paragraph 2 of Article 8 of the annexed provisions;
15. to depart
from Article 9 of the annexed provisions where, in the cases mentioned in that
Article, the injured party has a guarantee of compensation for damage to person
and property; the amount of compensation to which the injured party will be
entitled shall be the same in the case of personal injury as if there had been
an insurance; in respect of damage to property the amount of compensation may
be determined in some other manner.
16. to depart
from paragraph 2 of Article 9 of the annexed provisions in respect of motor
vehicles normally stationed outside its territory.
PROTOCOL OF SIGNATURE
When signing the European Convention on Compulsory Insurance
against Civil Liability in respect of Motor Vehicles the signatory Governments
recognise that the term "motor vehicles" contained in the first
paragraph of Article I of the provisions annexed to the said Convention shall
be understood to include all mechanic-ally-propelled vehicles which are
intended to be driven on the ground other than vehicles running on rails, even
if they are connected to electric conductors, and also cycles fitted with an
auxiliary engine.

DE LA RESPONSABILITE CIVILE EN MATIERE DE VEHICULES AUTOMOTEURS
Les Gouvernements signataires, Membres du Conseil de
l'Europe, Considerant que le but du Conseil de l'Europe est de realiser une
union plus etroite entre ses Membres afin, notamment, de favoriser leur progres
economique et social par la conclusion d'accords et par l'adoption d'une action
commune dans les domaines economique, social, culturel, scientifique, juridique
et administratif;
Estimant qu'il y a lieu de garantir, par l'instauration d'un
regime d'assurance obligatoire, les droits des victimes d'accidents causes par
la circulation des vehicules automoteurs sur leur territoire;
Estimant, d'autre part, qu'en cette matiere la realisation
de l'unification integrale du droit apparait comme malaisee et que, au surplus,
il suffit que les regles essentielles estimees indispensables soient communes
aux pays membres du Conseil de l'Europe, chacun d'eux conservant la liberte de
promulguer pour son territoire des dispositions augmentant la garantie au
profit des personnes lesees;
Estimant, enfin, qu'il y a lieu de favoriser la constitution
et le fonctionnement de bureaux internationaux d'assurance et de fonds de
garantie ou de prendre des mesures equivalentes,
Sont convenus de ce qui suit:
ARTICLE Ier
1. Chacune des Parties Contractantes
s'engage a ce que, au plus tard dans les six mois a partir de l'entree en
vigueur de la presente Convention a son egard, les droits des personnes ayant
subi sur son territorie un dommage cause par un vehicule automoteur soient
garantis par l'instauration d'un regime d'assurance obligatoire repondant aux
dispositions annexees a la presente Convention (annexe I).
2. Elle conserve toutefois la faculte
d'adopter des dispositions augmentant la garantie au profit des personnes
lesees.
3. Chacune des Parties Contractantes
communiquera au Secretaire General du Conseil de l'Europe les textes officiels
de sa legislation et de ses principales mesures reglementaires instaurant un
regime d'assurance obligatoire des vehicules automoteurs. Le Secretaire General
transmettra ces textes aux autres Parties ainsi qu'aux autres Membres du
Conseil de l'Europe.
ARTICLE 2
Chacune des Parties Contractantes conserve la faculte:
1. d'exempter de l'obligation d'assurance
certains vehicules automoteurs qui seraient consideres par Elle comme ne
presentant guere de danger;
2. d'exempter de l'obligation d'assurance
les vehicules automoteurs appartenant a des autorites publiques nationales ou
etrangeres ou a des organisations intergouvernementales;
3. de determiner les montants minimum pour
lesquels l'assurance devra etre prise; dans ce cas, l'application des
dispositions annexees pourra etre limitee aux montants ainsi determines.
ARTICLE 3
1. Chacune des
Parties Contractantes peut, au moment de la signature de la presente Convention
ou au moment du depot de son instrument de ratification ou d'adhesion, declarer
faire usage d'une ou de plusieurs reserves figurant a l'annexe II a la presente
Convention.
2. Chacune des
Parties Contractantes peut retirer, en tout ou en partie, une reserve formulee
par Elle en vertu du paragraphe precedent au moyen d'une notification adressee
au Secretaire General du Conseil de l'Europe et qui prendra effet a la date de
sa reception. Le Secretaire General en communiquera le texte aux autres Parties
ainsi qu'aux autres Membres du Conseil de l'Europe.
ARTICLE 4
1. Les facultes
et reserves dont il est fait usage par une des Parties Contractantes en vertu
des articles 2 et 3 de la presente Convention ne vaudront que sur le territoire
de cette Partie et ne pourront porter prejudice a l'application integrale de la
loi d'assurance obligatoire des autres Parties dont le territoire est parcouru.
2. Chacune des
Parties Contractantes fera connaitre au Secretaire General du Conseil de
l'Europe la teneur de ses dispositions nationales relatives aux facultes et
reserves visees aux articles 2 et 3 de la presente Convention. Elle tiendra le
Secretaire General informe de toute modification ulterieure y apportee. Le
Secretaire General communiquera toutes ces informations aux autres Parties
ainsi qu'aux autres Membres du Conseil de l'Europe.
ARTICLE 5
Lorsque la reparation d'un dommage cause par un vehicule
automoteur met en jeu a la fois l'assurance automobile obligatoire et le regime
de securite sociale, les droits de la personne lesee et le reglement a
intervenir entre les deux systemes seront determines dans le cadre des lois
nationales.
ARTICLE 6
1. Lorsque la
faculte d'exclusion de l'assurance normale visee au paragraphe 2 de l'article 4
des dispositions annexees est prevue dans sa loi nationale, toute Partie
Contractante s'engage a subordonner sur son territoire l'organisation des
courses ou concours de vitesse, de regularite ou d'adresse au moyen de vehicules
automoteurs, a une autorisation administrative. Cette autorisation ne pourra
etre accordee que si une assurance speciale repondant aux dispositions annexees
couvre la responsabilite civile des organisateurs et des personnes visees a
l'article 3 de ces dispositions.
2. Peut
toutefois etre exclue de cette assurance la reparation des dommages subis par
les occupants de vehicules qui participent aux courses ou concours vises au
paragraphe precedent.
ARTICLE 7
1. Les
vehicules automoteurs ayant leur stationnement habituel en dehors du territoire
de l'un des Etats Contractants seront dispenses sur ce territoire de
l'application de l'article 2 des dispositions annexees lorsqu'ils seront munis
d'une attestation du Gouvernement d'un autre Etat Contractant constatant que le
vehicule appartient a cet Etat ou, s'il s'agit d'un Etat federal, a celui-ci ou
a l'un de ses pays membres; dans ce dernier cas, l'attestation sera delivree
par le Gouvernement federal.
2. Cette
attestation designera l'autorite ou l'organisme qui sera charge de reparer le
dommage conformement a la loi du pays parcouru et qui sera susceptible d'etre
assigne devant les juridictions competentes selon cette loi. L'Etat ou le pays
auquel appartient ce vehicule se portera garant dudit reglement.
ARTICLE 8
Les Parties Contractantes favoriseront la constitution et le
fonctionnement de Bureaux destines a emettre des certificats internationaux
d'assurance ainsi qu'a regler les dommages dans le cas prevu a l'article 2,
paragraphe 2, des dispositions annexees.
ARTICLE 9
1. Chacune des
Parties Contractantes s'engage a prendre soit les mesures appropriees en vue de
la constitution d'un fonds de garantie, soit toute autre mesure equivalente,
afin d'indemniser les personnes lesees dans les circonstances ou la
responsabilite civile d'autrui est engagee pour le dommage, lorsque
l'obligation d'assurance n'a pas ete respectee ou lorsque la personne
civilement responsable n'a pas ete identifiee, ou encore dans les cas
d'exclusion autorises par la premiere phrase du paragraphe I de l'article 3 des
dispositions annexees. Chacune des Parties Contractantes determinera les
conditions d'octroi et l'etendue du droit a l'indemnisation.
2. Les
ressortissants de chacune des Parties Contractantes pourront faire valoir dans
un autre Etat Contractant le droit prevu au paragraphe precedent dans la meme
mesure que les ressortissants de ce dernier Etat.
ARTICLE 10
1. Les Parties
Contractantes s'engagent a determiner dans leur loi nationale les personnes
auxquelles incombe l'obligation de faire assurer le vehicule automoteur et a
prendre les mesures appropriees, en les assortissant au besoin de sanctions
penales ou administratives, afin que les obligations resultant des dispositions
annexees soient respectees.
2. Les Parties
Contractantes s'engagent a prendre dans leur legislation nationale, pour
l'application des dispositions annexees, les mesures appropriees concernant
l'agrement, la cessation et le retrait de l'agrement des assureurs et, le cas
echeant, du Fonds de garantie et du Bureau, ainsi que le controle de leurs
activites.
ARTICLE 11
1. Chacune des
Parties Contractantes determinera, s'il y a lieu, l'autorite ou la personne a
laquelle la notification prevue a l'article 9 des dispositions annexees sera
effectuee.
2. Chacune des
Parties Contractantes determinera les effets du contrat d'assurance en cas de
transfert de propriete du vehicule automoteur assure.
ARTICLE 12
Sauf en cas de necessite urgente, une Partie Contractante ne
pourra denoncer la presente Convention avant l'expiration d'un delai de deux
ans a compter de la date d'entree en vigueur de la Convention a son egard.
Toute denonciation se fera par un avis ecrit et notifie au Secretaire General
du Conseil de l'Europe qui en informera les autres Parties Contractantes; elle prendra
effet a l'expiration d'un delai de trois mois apres la date de la reception de
sa notification par le Secretaire General.
ARTICLE 13
1. Si, apres
l'entree en vigueur de la presente Convention a son egard, l'une des Parties
Contractantes estime necessaire de faire usage soit d'une reserve non visee a
l'annexe II a la presente Convention, soit d'une reserve visee a cette annexe,
mais dont Elle n'avait pas fait usage anterieurement ou a laquelle Elle aurait
renonce, cette Partie Contractante en notifiera la proposition precise au
Secretaire General du Conseil de l'Europe, qui la communiquera aux autres
Parties Contractantes.
2. Si celles-ci
signifient par ecrit, et dans le delai de six mois qui suit la communication
par le Secretaire General, leur accord a cette proposition, la Partie
Contractante qui l'a faite peut modifier sa legislation dans le sens envisage.
Le Secretaire General portera les communications qui lui parviennent en vertu
du present paragraphe a la connaissance des Parties Contractantes.
ARTICLE 14
La presente Convention ne s'applique pas aux territoires
d'outremer des Parties Contractantes.
ARTICLE 15
1. La presente Convention est ouverte a la
signature des Membres du Conseil de l'Europe. Elle sera ratifiee. Les
instruments de ratification seront deposes pres le Secretaire General du
Conseil de l'Europe.
2. La presente Convention entrera en
vigueur 90 jours apres la date du depot du quatrieme instrument de
ratification.
3. Pour tout signataire qui la ratifiera
ulterieurement, la Convention entrera en vigueur 90 jours apres la date du
depot de son instrument de ratification.
4. Le Secretaire General notifiera a tous
les Membres du Conseil, ainsi qu'aux Etats adherents, les noms des signataires,
l'entree en vigueur de la Convention, les noms des Parties Contractantes qui
l'auront ratifiee, ainsi qui le depot de tout instrument de ratification ou
d'adhesion intervenu ulterieurement.
ARTICLE 16
Apres l'entree en vigueur de la presente Convention, le
Comite des Ministres du Conseil de l'Europe peut inviter tout Etat non membre
du Conseil a adherer a celle-ci. Tout Etat ayant reçu cette invitation pourra
adherer a la Convention en deposant son instrument d'adhesion pres le
Secretaire General du Conseil, qui notifiera ce depot a toutes les Parties
Contractantes ainsi qu'aux autres Membres du Conseil de l'Europe. Pour tout
Etat adherent, la Convention entrera en vigueur 90 jours apres la date du depot
de son instrument d'adhesion.
En foi de quoi, les soussignes dument autorises a cet effet,
ont signe la presente Convention.
Fait a Strasbourg, le 20 avril 1959, en français et en
anglais, les deux textes faisant egalement foi, en un seul exem plaire qui sera
depose dans les archives du Conseil de l'Europe.
Le Secretaire General en communıquera des copies certifiees
conformes a tous les signataires.

DISPOSITIONS ANNEXEES A LA CONVENTION
ARTICLE Ier
On entend dans la presente loi:
par "vehicules automoteurs": les vehicules
destines a circuler sur le sol et qui peuvent etre actionnes par une force
mecanique, sans etre lies a une voie ferree, les remorques attelees ainsi que
les remorques, meme non attelees, qui seront determinees par le Gouvernement,
lorsque celles-ci ont ete construites en vue d'etre attelees a un vehicule
automoteur et sont destinees au transport de personnes et de choses; par
"assures": les personnes dont la responsabilite est couverte
conformement aux dispositions de la presente loi; par "personnes
lesees": les personnes ayant un droit a la reparation du dommage cause par
le vehicule automoteur; par "assureur": l'entreprise d'assurance
agreee par le Gouvernement aux termes de l'article 2, paragraphe Ier, et, dans
le cas du paragraphe 2 du meme article, le Bureau assumant la charge de reparer
le dommage cause sur le territoire national par des vehicules ayant leur
stationnement habituel en dehors de ce territoire.
ARTICLE 2
1. Les
vehicules automoteurs ne sont admis a circuler sur la voie publique, sur les
terrains ouverts au public et sur les terrains non publics mais ouverts a un
certain nombre de personnes ayant le droit de les frequenter, que si la
responsabilite civile a laquelle ils peuvent donner lieu est couverte par une
assurance repondant aux dispositions de la presente loi. L'assurance doit etre
contractee aupres d'un assureur agree a cette fin par le Gouvernement.
2. Toutefois,
les vehicules automoteurs ayant leur stationnement habituel en dehors du
territoire national sont admis a la circulation sur ce territoire, a la condition
qu'un Bureau, reconnu a cette fin par le Gouvernement, assume lui-meme a
l'egard des personnes lesees la charge de reparer, conformement a la loi
nationale, les dommages causes par ces vehicules.
ARTICLE 3
1. L'assurance
doit couvrir la responsabilite civile du proprietaire, de tout detenteur et de
tout conducteur du vehicule assure, a l'exclusion de la responsabilite civile
de ceux qui se seraient rendus maitres du vehicule soit par vol ou violence,
soit simplement sans l'autorisation du proprietaire ou du detenteur. Toutefois,
dans ce dernier cas, l'assurance doit couvrir la responsabilite civile du
conducteur lorsqu'il lui a ete possible de se rendre maitre du vehicule par une
faute du proprietaire ou du detenteur, ou lorsque le conducteur est une
personne preposee a la conduite du vehicule.
2. L'assurance
doit comprendre les dommages causes aux personnes et aux biens par des faits
survenus sur le territoire national, a l'exception des dommages causes au
vehicule assure et aux biens transportes par celui-ci.
ARTICLE 4
1. Peuvent etre
exclus du benefice de l'assurance:
(a) le conducteur du
vehicule ayant occasionne le dommage, ainsi que le preneur d'assurance et tous
ceux dont la responsabilite civile est couverte par la police:
(b) le conjoint des personnes
visees a l'alinea precedent;
(c) les membres de la
famille de ces memes personnes, soit habitant sous leur toit ou entretenus de
leurs deniers, soit transportes dans le vehicule ayant occasionne le dommage.
2. Peuvent etre
exclus de l'assurance normale les dommages qui decoulent de la participation du
vehicule a des courses ou concours de vitesse, de regularite ou d'adresse
autorises.
ARTICLE 5
Si le contrat stipule que l'assure contribuera
personnellement, dans une certaine mesure, au reglement du dommage, l'assureur
n'en demeure pas moins tenu envers la personne lesee au paiement de la
contribution qui, en vertu du contract, est a la charge de l'assure.
ARTICLE 6
1. La personne
lesee possede un droit propre contre l'assureur.
2. S'il y a
plusieurs personnes lesees et si le total des indemnites dues excede la somme
assuree, les droits des personnes lesees contre l'assureur sont reduits
proportionnellement jusqu'a concurrence de cette somme. Cependant, l'assureur
qui a verse de bonne foi a une personne lesee une somme superieure a la part
lui revenant, parce qu'il ignorait l'existence d'autres pretentions, ne demeure
tenu envers les autres personnes lesees que jusqu'a concurrence du restant de
la somme assuree.
ARTICLE 7
1. Les assures
doivent declarer a l'assureur tous les sinistres dont ils ont connaissance. Le
preneur d'assurance doit fournir a l'assureur tous renseignements et tous
documents prescrits par le contrat d'assurance. Les assures autres que le
preneur doivent fournir tous les renseignements et documents necessaires a
l'assureur, a la demande de celui-ci.
2. L'assureur
peut mettre l'assure en cause dans le proces qui lui est intente par la
personne lesee.
ARTICLE 8
1. Toute action
basee sur le droit propre de la personne lesee contre l'assureur se prescrit
par deux ans, a compter du fait generateur du dommage.
2. Une
reclamation ecrite suspend la prescription a l'egard de l'assureur jusqu'au
jour ou celui-ci declare par ecrit qu'il rompt les negociations. Les
reclamations ulterieures ayant le meme objet ne suspendent pas la prescription.
ARTICLE 9
1. L'assureur ne peut opposer a la personne
lesee les droits de refuser ou de reduire ses prestations qu'il possede a
l'egard de l'assure en vertu du contrat ou des dispositions legales y afferentes.
2. L'assureur ne peut opposer a la personne
lesee la nullite ou la cessation du contrat, sa suspension ou celle de la
garantie, que pour les sinistres survenus apres l'expiration d'un delai de 16
jours suivant la notification par l'assureur de la nullite, de la cessation ou
de la suspension. En cas d'assurances consecutives, cette disposition ne
s'appliquera qu'au dernier assureur.
3. Toutefois, les dispositions des
paragraphes precedents ne sont pas applicables dans la mesure ou le dommage est
effectivement couvert par une autre assurance.
4. Les dispositions contenues aux
paragraphes 1 et 2 du present article ne prejugent en rien du droit de recours
de l'assureur contre le preneur d'assurance ou un assure autre que le preneur
d'assurance.
ARTICLE 10
Il ne peut etre deroge, par des conventions entre
particuliers, aux dispositions de la presente loi prises en faveur des
personnes lesees, sauf si une telle faculte resulte de ces dispositions.
ANNEXE II
RESERVES A LA CONVENTION
RESERVES A LA CONVENTION
Chacune des Parties Contractantes peut declarer vouloir:
1. exempter de l'obligation d'assurance les
vehicules automoteurs appartenant a des personnes morales de droit public ou de
droit prive qui justifieront de garanties financieres suffisantes pour demeurer
leur propre assureur;
2. remplacer l'assurance par le depot d'un
cautionnement pour certaines personnes a determiner par Elle, a condition que
ce cautionnement offre pour les personnes lesees des garanties equivalentes a
celles prevues par l'assurance;
3. exclure de l'obligation de l'assurance
les dommages causes intentionnellement par un assure;
4. exclure de l'obligation de l'assurance
les cas vises dans la seconde phrase du paragraphe 1 de l'article 3 des
dispositions annexees;
5. exclure de l'obligation de l'assurance
le cas de l'utilisation d'un vehicule sans l'autorisation du proprietaire ou
detenteur ou malgre l'interdiction de ces derniers, a condition que la personne
lesee possede la garantie d'etre indemnisee au moins en ce qui concerne les
dommages corporels;
6. exempter de l'obligation de l'assurance
le prejudice moral;
7. exclure du benefice de l'assurance,
lorsque l'assure est une personne morale ou une societe de droit commercial ne
possedant pas la personnalite juridique propre, les representants legaux de
l'assure ainsi que leur conjoint, et, dans les conditions prevues au paragraphe
1er, sous (c), de l'article 4 des dispositions annexees, les membres de la
famille de ces representants;
8. exclure du benefice de l'assurance d'un
vehicule automoteur toute personne qui consent a etre transportee par ce
vehicule alors qu'elle sait ou dev rait savoir que celui-ci a ete soustrait a
son possesseur legitime par des moyens illicites ou est utilise pour perpetrer
un crime;
9. exempter de l'obligation de l'assurance
les dommages causes aux personnes transportees par le vehicule ayant occasionne
le dommage dans le cas de transport gratuit ou benevole;
10. exempter de l'obligation d'assurance les
vehicules lorsqu'ils circulent sur des terrains non publics mais ouverts a un
certain nombre de personnes ayant le droit de les frequenter, et lorsqu'ils
participent, ailleurs que sur la voie publique, a des courses ou a des concours
de vitesse, de regularite ou d'adresse;
11. apporter, uniquement dans les rapports
entre ses nationaux, des derogations a l'article 5 des dispositions annexees,
quant aux dommages materiels d'un faible montant;
12. laisser a ses tribunaux le soin
d'apprecier si, en cas de dommage cause sur son territoire, il est fait
application de l'article 6 des dispositions annexees, les tribunaux etant
informes au besoin des principes a respecter;
13. apporter des
derogations au paragraphe 2 de l'article 6 des dispositions annexees en vue
d'etablir un autre reglement de repartition de la somme assuree;
14. apporter des derogations aux dispositions
du paragraphe 2 de l'article 8 des dispositions annexees;
15. apporter des derogations a l'article 9 des
dispositions annexees, lorsque, dans les cas vises a cet article, la personne
lesee possede la garantie d'etre indemnisee pour les dommages corporels et
materiels; l'indemnite a laquelle pourra pretendre la personne lesee sera
accordee en cas de dommages corporels dans la meme mesure que s'il y avait une
assurance et en cas de dommages materiels dans une mesure qui pourra etre fixee
differemment.
16. deroger au paragraphe 2 de l'article 9 des
dispositions annexees en ce qui concerne les vehicules automoteurs ayant leur
stationnement habituel en dehors de son territoire.
PROTOCOLE DE SIGNATURE
En signant la Convention europeenne relative a l'assurance
obligatoire de la responsabilite civile en matiere de vehicules automoteurs,
les Gouvernements signataires reconnaissent que sont compris dans la definition
du terme "vehicules automoteurs" figurant au premier alinea de l'article
1er des dispositions annexees a ladite Convention, tous les vehicules destines
a circuler sur le sol et qui peuvent etre actionnes par une force mecanique
sans etre lies a une voie ferree meme si ceux-ci sont relies a un conducteur
electrique, ainsi que les cycles pourvus d'un moteur auxiliaire.
